Reuters reported that following U.S. District Judge Leo Sorokin, another federal judge on the 30th blocked President Donald Trump's measure to increase the H-1B visa application fee to an unprecedented $100,000. U.S. District Judge Haywood Gilliam of Oakland, California, ruled on the 30th that U.S. Citizenship and Immigration Services (USCIS) and the Department of State failed to follow the necessary regulatory procedures before implementing Trump's fee. Gilliam, appointed by then-Democratic President Barack Obama, agreed to a request from a coalition of unions, employers, and non-profit organizations, preventing these agencies from implementing Trump's fee policy until their lawsuit, filed last October, yields a result. In June, Boston Judge Sorokin ruled to temporarily block the fee in another case brought by 20 states. The U.S. Court of Appeals for the First Circuit in Boston rejected the Trump administration's request in July to stay the lower court's order. The Trump administration argued at the time that the fee was a legitimate penalty that the president had the authority to impose under federal immigration law. Federal immigration law grants the president the power to restrict the entry of certain foreign nationals when he deems their entry "detrimental to the interests of the United States." In August, the U.S. Department of Homeland Security began actions to adopt a permanent fee of approximately $103,000, which may face legal challenges once finalized. However, this would involve different legal issues than the lawsuits concerning the fees set by Trump, which primarily focus on whether the president has the unilateral authority to set such fees. The $100,000 fee was originally set to expire on September 21st, but Republican Trump recently extended it for another year. The White House did not immediately respond to a request for comment.
