[Cross-Strait] Lawyer Sued for Heavy Sentence for Providing False Information for Chinese Nationals to Apply for Entry to Taiwan

Lawyer Chen Zhen-wei, who runs an immigration consulting firm, is suspected of providing false business plans, itineraries, and other documents to allow Chinese nationals to apply for entry to Taiwan for business activities. One of the Chinese visitors has a background in the National People's Congress. The Taipei District Prosecutors Office announced today (11th) that Chen and seven others have been indicted for violating the Act Governing Relations Between the People of the Taiwan Area and the Mainland Area, among other charges, and are seeking a heavy sentence for Chen.
According to the indictment, Chen Zhen-wei is the presiding lawyer of Wei-Duo International Law Firm and the actual person in charge of Wei-Duo Immigration Consulting Co. Shi Feng-shen is the actual person in charge of Jia-Wei International Immigration Consulting Co. Lai Yu-tang and Lai Yu-hsiu are the actual persons in charge of Yun-Chang Co. Lin Gui-hong is the person in charge of Yu-Tai-Hong International Co., and Xu Zhi-qing is the person in charge of Zhi-Tai Technology Co. Chen Zhen-wei met Lai Yu-hsiu and Lin Gui-hong through his legal practice and had a business cooperation relationship with Shi Feng-shen through his work at Wei-Duo Immigration Consulting Co.
According to relevant regulations, when mainland Chinese residents apply to enter Taiwan for business activities, the inviting unit must use a business certificate to upload proof of employment, guarantee letters, letters of authorization, business-related activity plans and itineraries, copies of contracts, company registration forms of the inviting unit, and the previous year's income tax settlement declaration form to the National Immigration Agency's website for online application.
The prosecution pointed out that Chen Zhen-wei and Shi Feng-shen had a business cooperation relationship in handling overseas immigration for mainland Chinese residents. They introduced mainland Chinese residents Zhu Nai-xian, Sun Tao, and Li Feng-xiang to enter Taiwan to attend interviews at the Belize Embassy in Taiwan for applications for Belize passports and nationality, and received a reward of US$80,000 per nationality application, from which Chen Zhen-wei took a commission of US$5,000.
The prosecution found that Chen Zhen-wei collaborated with Lin Gui-hong, who provided the company seals of Yu-Tai-Hong Co. for Chen Zhen-wei to create false business activity plans and itineraries. After Chen Zhen-wei handed these documents to Shi Feng-shen, Shi Feng-shen then gave them to travel agents. Using Yu-Tai-Hong Co. as the inviting unit, they applied online through the National Immigration Agency's website for Zhu Nai-xian, Sun Tao, and Li Feng-xiang to enter Taiwan under the guise of business performance.
Based on this false information, the National Immigration Agency mistakenly approved Zhu Nai-xian's entry on September 16, 2023, and departure on September 20, 2023; Sun Tao's entry on October 10, 2023, and departure on October 15, 2023. Li Feng-xiang's application was rejected by the Immigration Agency because she did not declare her background in the National People's Congress. Yu-Tai-Hong Co. did not provide supplementary documents, and Li Feng-xiang did not enter Taiwan.
The prosecution stated that Lai Yu-tang, for unknown reasons, intended to introduce Chinese national Lu Tao to Taiwan for a short stay and entrusted Chen Zhen-wei to assist with the process for NT$25,000. First, Lai Yu-tang and Lai Yu-hsiu, under the name of Yun-Chang Co., created false business activity plans and itineraries and applied to the Immigration Agency. However, the application was not approved because Yun-Chang Co. did not meet the qualifications for an inviting unit.
The prosecution pointed out that Chen Zhen-wei and others later approached Xu Zhi-qing, Lin Gui-hong's boyfriend, and obtained the company seals of Zhi-Tai Technology Co. Chen Zhen-wei and others then used these to create false business activity plans and itineraries to apply for Lu Tao's entry to Taiwan under the guise of business performance. The Immigration Agency mistakenly approved Lu Tao's entry on July 30, 2024, and departure on August 3, 2024.
The Taipei District Prosecutors Office announced today that Chen Zhen-wei and seven others have been indicted for violating the Act Governing Relations Between the People of the Taiwan Area and the Mainland Area. The prosecutor believes that Chen Zhen-wei's actions have severely undermined the effectiveness of the National Immigration Agency's border management and the credibility of the legal profession, creating a potential national security loophole.
