[Finance] Indonesian Nickel Mining Dispute Appeals Across Borders; Civil Groups Urge Ministry of Economic Affairs to Activate Taiwan's NCP Mechanism

The Foundation for Environmental Rights Advocacy (ERA) and Indonesian community groups went to the Ministry of Economic Affairs today (1st) to file Taiwan's first "National Contact Point" (NCP) complaint, urging the Ministry to formally activate the NCP mechanism and facilitate dialogue between corporations and affected stakeholders. The civil groups pointed out that the Executive Yuan designated the Ministry of Economic Affairs as Taiwan's NCP as early as 2024, but the complaint window and processing procedures remain unclear. As corporate cross-border investment and supply chain human rights issues gain attention, the Organisation for Economic Co-operation and Development (OECD) established the "Guidelines for Multinational Enterprises" requiring the establishment of National Contact Points (NCPs) as a platform for dispute resolution and mediation outside of judicial litigation, to address issues such as human rights, labor, and the environment that may arise during corporate cross-border operations. The Executive Yuan designated the Ministry of Economic Affairs as Taiwan's NCP in September 2024, responsible for cross-ministerial coordination and handling complaints of corporate human rights violations. However, the ERA stated that a clear complaint window and processing procedure have not yet been seen, leading them to go to the Ministry of Economic Affairs on the 1st with Indonesian groups, local residents, and union representatives to formally file the first NCP complaint. Yan Shi-cheng, a lawyer with the ERA, stated that Taiwanese companies' economic and trade influence globally continues to expand, but overseas investments can also impact local environments and residents' rights. This complaint focuses on the Indonesian nickel mining supply chain. Nickel is a crucial raw material for energy transition in batteries and electric vehicles, but its extraction and processing also lead to deforestation, environmental damage, and labor and human rights issues. Yan Shi-cheng pointed out that civil groups have attempted direct stakeholder engagement with relevant Taiwanese companies over the past two years with limited success, thus hoping for government intervention and mediation. He said: "(Original sound) As early as 2024, two years ago, the Ministry of Economic Affairs was designated by the Executive Yuan to establish a National Contact Point to mediate environmental and human rights disputes and controversies involving Taiwanese enterprises and local Indonesian groups like ours. But two years have passed, and the Ministry of Economic Affairs has still not clearly announced where the NCP's reception window is, nor how the complaint and processing procedures should be carried out." The Indonesian environmental groups participating in the complaint highlighted that nickel mining development in Indonesia, in addition to environmental impacts, also involves labor safety and local community rights, including working conditions in industrial zones, personal protective equipment, and the impact of mining development on forests, water sources, and fishing grounds. They hope that after the Ministry of Economic Affairs accepts the case, it will facilitate substantive dialogue between corporations and affected groups in accordance with OECD guidelines. The ERA emphasized that NCPs are not judicial litigation mechanisms but aim to use the government-established coordination platform to enable communication between corporations and affected workers, residents, and civil groups. As Taiwanese companies continue to expand their overseas presence, how the government can move the announced NCP from policy declaration to actual operation will be a crucial part of Taiwanese enterprises implementing responsible business practices.
